O presente trabalho busca, através de revisão bibliográfica, tratar sobre a garantia do direito constitucional à moradia considerando a ocupação de Áreas de Proteção Permanente, buscando evidenciar a compatibilização da moradia e do meio ambiente. Dessa forma, lança-se mão da previsão que a própria lei dispõe, permitindo a supressão de vegetação nessas áreas, como exceção, para que assim, após a regularização através do Termo de Ajustamento de Conduta, seja solucionado o conflito de direitos fundamentais e, com isso, haja a implantação de infraestrutura de saneamento básico, impondo condições aos ocupantes, de cooperação com o meio inserido.

The present work seeks, through bibliographic review, to deal with the guarantee of the right to housing even in Permanent Protection Areas, evidencing the non - violation of the right to the environment. In this way, it is possible to reduce the vegetation in these areas, as an exception, so that, after regularization through the Term of Adjustment of Conduct, the conflict of fundamental rights is solved, and with that, the implantation of basic sanitation infrastructure, imposing conditions to the occupants, of cooperation with the inserted environment.
