A despeito do reconhecimento dos Direitos Humanos na esfera internacional por ocasião da Declaração Universal dos Direitos Humanos de 1948, nota-se que a sua aplicação prática nem sempre é algo fácil de ser alcançando. Portanto, o escopo do presente artigo é analisar como se desenvolve a proteção dos Direitos Humanos em relação às minorias, em especial, dos povos tradicionais da América Latina. O objetivo geral é despertar no leitor o pensamento crítico acerca da Decolonialidade e chamar sua atenção para a importância de se buscar um Direitos Humanos intercultural que atenda aos verdadeiros anseios das populações tradicionais, onde é reconhecido sua diversidade. O objetivo específico é analisar como tem sido a busca pela proteção dos direitos dessas pessoas a partir da jurisprudência da Corte Interamericana de Direitos Humanos (CIDH). Para isso, o trabalho utiliza métodos bibliográficos como doutrina especializada e instrumentos jurídicos regionais e internacionais que permitem melhor percepção sobre a realidade da evolução do direito internacional na proteção dos direitos dos povos tradicionais. Portanto, o presente tema é atual e merece a atenção da comunidade regional e internacional, a fim de que sejam promovidas políticas públicas mais eficientes e que o sistema de proteção dos direitos humanos dos povos tradicionais esteja em constante ascensão.

Despite the recognition of human rights in the international sphere on the occasion of the 1948 Universal Declaration of Human Rights, its practical application is not always easy to achieve. Therefore, the scope of this article is to analyze how the protection of human rights in relation to minorities, especially the traditional peoples of Latin America, develops. The general objective is to awaken inthe reader the critical thinking about Decoloniality and to draw their attention to the importance of seeking an intercultural Human Rights that meets the true aspirations of the traditional populations, where their diversity is recognized. The specific objective is to analyze how has been the search for the protection of the rights of these people from the jurisprudence of the Inter-American Court of Human Rights (IACHR). For this, the work uses bibliographic methods as specialized doctrine and international and regional legal instruments that allow better perception about the reality of the evolution of international law in the protection of the rights of traditional peoples. Therefore, the present theme is current and deserves the attention of the regional and international community in order to promote more efficient public policies and that the system of protection of the human rights of traditional peoples is constantly on the rise.
