O presente trabalho faz uma análise de como se deu a organização do movimento de mulheres e feministas para a elaboração da chamada Carta das Mulheres à Constituinte. À luz da Teoria feminista do Direito investiga como esse documento impactou para que muitos dos direitos que temos hoje garantidosàs mulheres pudessem ser concretizados. Nesse sentido utiliza-se a referida carta como fonte de análise da pesquisa e seu consequente desdobramento para efetivação de alguns desses direitos até serem garantidos. Passando, portanto, pela organização dos movimentos feministas, pela promulgação da Constituição Cidadã de 1988 e também por leis especificas sancionadas mais tarde. Delineia-se como ponto fulcral da pesquisa ainda a questão da violência contra mulher no Brasil. Para isso também se faz um percurso histórico para demonstrar que até chegarmos em leis especificas como a Lei 11.340/2006, Lei Maria da Penha e a Lei 13.104/2015, Lei do Feminicídio levamos mais de três décadas de lutas que perpassaram por períodos ditatoriais e democráticos.



Resumo Inglês:

The present work analyzes the organization of the women's and feminist movement for the elaboration of the so-called Women's Letter to the Constituent. In the light of the feminist theory of law, it investigates how this document impacted so that many of the rights that we have today guaranteed to women could be realized. In this sense, the aforementioned letter is used as a source of analysis of the research and its consequent outcome for the realization of some of these rights until they are guaranteed. Passing, therefore, through the organization of feminist movements, the promulgation of the Citizen Constitution of 1988 and also by specific laws sanctioned later. The issue of violence against women in Brazil is also outlined as a focal point of the research. For this purpose, a historical path is also taken to demonstrate that until we reached specific laws such as Law 11.340 / 2006, Law Maria da Penha and Law 13.104 / 2015, the Law of Feminicide we took more than three decades of struggles that passed through dictatorial periods and democratic.
