O presente artigo pretende analisar a produção da criminologiapositiva como nova estratégia do processo de “Outrificação” em relação aospovos indígenas. Demonstra-se o processo de criação do “Outro” indesejávelutilizado para o avanço do projeto colonizador e, portanto, universalizante,das classes dominantes. Nesse sentido, o enfoque se dá ao esforço discursivodespendido à estigmatização racista e etnocida da população indígena.

The current article investigates the intermediation of PositivistCriminology in the maintenance of colonial traditions concerning indigenouspeople in Brazil, considering that the criminal law constitutes a tool to settle theconcept of "Othering" by means of suffocation of alterity. Futhermore, it looksinto the hegemonic narrative in which the secular stigmatization is legitimized.
