O1 artigo2 tenta explorar as reflexões e tendências metodológicas mais significativas da historiografia jurídica da América do Sul acerca da circulação do pensamento penal positivista italiano na América Latina entre os séculos XIX e XX. A pesquisa, que não pretende fornecer uma bibliografia completa, privilegia um percurso capaz de identificar viradas temáticas e aberturas de novos horizontes hermenêuticos.
The aim of this essay is to explore the most significant reflections of South American legal historiography methodological trend. In this present case, the focus is on the Italian penal positivist thought, which spread throughout Latin America between the nineteenth and twentieth centuries. The survey does not claim to provide a complete bibliography, but it rather favours a path that identifies themes and cues that can allow multiple and new interpretations.
