Diante das transformações tão anunciadas pela academia a respeito de um sistema infracional democrático, acusatório e, simultaneamente, atento às especificidades de seus sujeitos em desenvolvimento, este trabalho busca responder à questão: que aspectos da prática processual precisam ser revistos para que os direitos e garantias dos adolescentes possam ser efetivados? O trabalho apresenta os resultados de uma pesquisa de observação não participante de 60 audiências de revisão da medida socioeducativa de internação na região norte do estado do Rio Grande do Sul. Os resultados mostram que a composição dos adolescentes e seus acompanhantes obedeceu à estrutura de opressão de gênero, raça e classe, contrastando com a composição das pessoas que definiam seu futuro na mesma oportunidade. Houve a majoritária obediência aos relatórios, e o direito de defesa não foi respeitado. As conclusões apontam para a necessidade de efetivação das garantias processuais e atenção à pluralidade das equipes que avaliam a internação e da superação da ideologia tutelar; à compreensão da educação como direito e não como pena; e da possibilidade de reintegração social apesar da internação e não através dela.
Faced with the transformations so publicized by the academy about a democratic, accusatory and at the same time attentive system to the specificities of its developing subjects, this paper seeks to answer the question: which aspects of procedural practice need to be revised so that the rights and guarantees of adolescents can be fulfilled? The study presents the results of a non-participant observation survey of 66 audiences reviewing the socio-educational measure of deprivation of liberty in the northern region of the state of Rio Grande do Sul. The results show that the composition of adolescents and their companions obeyed the structure of oppression of gender, race and class, contrasting with the composition of the people who defined their future at the same opportunity. There was majority compliance with the reports, and the right of defense was not respected. The conclusions point to the need for effective procedural guarantees and attention to the plurality of the teams that evaluate hospitalization and overcoming the tutelary ideology; the understanding of education as a right not as a penalty; and the possibility of social reintegration despite deprivation of liberty and not through it.
