O artigo busca demonstrar como é possível a punição em um processo penal liberal e democrático, quais os níveis de exigências probatórias para que a hipótese acusatória permita a punição do sujeito em um processo penal. O marco teórico do trabalho está no garantismo penal de Ferrajoli e na teoria agnóstica de Zaffaroni, que se conecta com a instrumentalidade autoritária do processo penal. Com isso, é preciso reconhecer a busca por uma perspectiva crítica e integrada das ciências penais (ou do saber penal), cujo desdobramento já escoa na visão mais moderna de descolonialidade. Desse modo, é possível perceber como a concepção dos standards probatórios, descolado da visão crítica que constitui a premissa teórica do presente trabalho, é tragado pelas brechas instrumentais e operacionais de um processo penal autoritário no Brasil, cujo o código de processo penal tem matrizes no fascismo italiano da década de 40 do século passado. Assim, o problema a ser investigado é como será possível a punição.
The present article aims to demonstrate how it is possible to aply punishment to the people condemned for commiting crimes through a liberal and democratic criminal process, analyzing the required standard of proof is required. The theoretical basis of the work is the legal garantism theory, written by Luigi Ferrajoli, and the agnostic theory of punishment, by Eugenio Raúl Zaffaroni, which connects with the authoritarian instrumentalization of the criminal prosecution. In this sense, it is necessary to recognize the importance of a critical and integrated perspective of study of the criminal sciences (or criminal knowledge), whose unfolding is already flowing in the most modern view of decoloniality. It is possible to notice how a conception of standards of proof detached from the critical view that constitutes the theoretical premise of the present work, is obscured by instrumental and operational nuances of an authoritarian criminal prosecution in Brazil, whose code of criminal procedure has influences of the Italian fascism of the 40’s of last century. Thus, the problem to be investigated is how to punish in a democratic an liberal state.
