A pesquisa realizada tem a pretensão de discutir e problematizar questões sobre a regularização fundiária brasileira na contemporaneidade, levando-se em consideração o estudo do caso sobre a Zona Especial de Interesse Social (ZEIS) Monte Sinai, localizada na cidade de Araguaína, Tocantins. Esta investigação caracteriza-se como uma pesquisa bibliográfica e tem como objetivo precipuamente trazer à tona discussões a respeito dos paradigmas urbanos, entrelaçados com as garantias constitucionais do Direito à cidade e à moradia, explorando a sua efetivação no contexto social observamos que em matéria legiferante, houve uma evolução no tocante à regulamentação da política urbana e do direito à cidade, constantes nos artigos 182 a 183 da Constituição Federal. No que diz respeito à efetivação de tais garantias, as políticas públicas implementadas ainda não conseguiram uma atuação efetiva que reorganize os dilemas fundiários.

The research discusses and problematizes questions about the Brazilian land regularization in contemporary times. Taking into account the study of the case of the Special Area of Social Interest (ZEIS) Monte Sinai, located in Araguaína, Tocantins. This research is a bibliographical study and aims to discuss urban paradigms, intertwined with the constitutional guarantees of the right to the city and housing. Another aim is to explore its effectiveness in the social context. We have observed that in legislation, there has been an evolution concerning the regulation of urban policy and the right to the city, included in articles 182 to 183 of the Federal Constitution. Regarding the effectiveness of these guarantees, the executed public policies have not yet managed an effective action to reorganize the land dilemmas.
