O artigo analisa, por meio de pesquisa bibliográfica, a possibilidade de justificação de algoritmos de acidente em carros autônomos, especificamente, os casos envolvendo a escolha de uma vítima originalmente não atingida, por meio da figura da colisão de deveres. Para tanto, ele se estrutura em três momentos: considerações sobre os veículos autônomos e apresentação do caso reitor; explanação sobre a colisão de deveres; e concretização da colisão de deveres ao caso reitor. Ao final, conclui-se pela incompatibilidade da utilização daquela causa de justificação ao caso descrito.
Resumo Inglês:
The article analyzes, through literature research, the possibility of justification of accident algorithms in autonomous cars, especially cases involving the choice of a victim originally not hit, through the figure of the collision of duties. To this end, it proceeds in three moments: considerations about autonomous vehicles and presentation of the work case; explanation about the collision of duties; concretion of the collision of duties to the work case. At the end, it concluded that it is incompatible using that cause of justification in the case described.
