A TURBULÊNCIA NA VOCAÇÃO SUCESSÓRIA NA COMUNA DA CHIPIPA À LUZ DO ARTIGO 2133.º DO CÓDIGO CIVIL ANGOLANO

Tem-se verificado por quase em todo território nacional turbulências na sucessão, principalmente no momento da vocação sucessória. Geralmente os parentes do de cujus tendem a apropriar-se dos bens por ele deixado, os sucessíveis prioritários ficam sem nada, alegando como fundamento o costume. O presente trabalho tem como objectivo principal: Minimizar os feitos da turbulência na vocação sucessória na Comuna da Chipipa à luz do artigo 2133.º do Código Civil angolano. Neste trabalho procurou-se determinar o estado actual, no qual constatou-se que comportamentos como estes são visíveis principalmente quando o cônjuge sobrevivo não tiver filhos com o de cujus. Constatou-se limitações no direito de testar. Verificado o estado actual, propôs-se medidas para minimizar a turbulência no momento da vocação sucessória, como palestras sobre o fenómeno sucessório. O trabalho está dividido por: Introdução onde espelhou-se as razões da escolha do tema; Fundamentação Teórica, nesta parte do trabalho procurou-se falar do Direito Sucessório no geral, com destaque nos momentos do fenómeno sucessório (vocação sucessória); Fundamentação Metodológica, o capítulo no qual mostrou-se os métodos usados bem como a razão da sua aplicação; Colecta e análise dos dados, capítulo onde fez-se a caracterização geográfica, mostrou-se as percentagens dos resultados do questionário e súmulas; Conclusão, nesta parte, procurou-se dar resposta naquilo que foi o objectivo; Recomendações do trabalho, propôs-se algumas atitudes que devem ser seguidas; Bibliografia, espelhamos os manuais e sites que foram consultados para a elaboração deste trabalho.

It has been verifying for almost in every territory national turbulences in the succession, mainly in the moment of the vocation successor. Usually the relatives of the one of fleeced tend to adapt of the goods for him left, the priority successive are without anything, alleging as foundation the habit. The present work has as main objective: to Mitigate the turbulence in the vocation successor in the Commune of Chipipa to the light of the article 2133.º of the Angolan Civil Code. In the commune of Chipipa, commune of the Municipal district of Huambo, the reality is not different, in this he/she worked tried to determine the state actual, that can be consisted behaviors as these are visible mainly when the spouse survives doesn't have children with the one of fleeced, and she also is not permitted that in the will is indicated a friend or an institution to inherit the goods. Verified the state actual intended measures to mitigate the turbulence in the moment of the vocation successor, as lectures on the phenomenon successor. The work is divided for: Introduction where was mirrored the reasons of the choice of the theme; Theoretical Fund mentation, in this part of the work tried to speak of the law Successor in the general, with prominence in the moments of the phenomenon successor and vocation successor; Methodological Fund mentation, the chapter in which was shown the used methods as well as the reason of his/her application; Collect and analysis of the data, chapter where was made the geographical characterization of the commune of Chipipa, was shown the percentages of the results of the questionnaire and simulate of the results; Conclusion, in this part of the work tried to give answer in that was the objective of the work; Recommendations of the work, he/she intended some attitudes that should be following to avoid the turbulence in the moment of the vocation successor; Bibliography, we mirrored the manuals and sites that were consulted for the elaboration of this work.
