O excesso de demandas judiciais fez com que o Poder Judiciário brasileiro adotasse a contratação de assistentes judiciais como uma das estratégias para dar vazão a tamanha carga de trabalho. Os assistentes auxiliam em importantes etapas do processo decisório, sendo que, nos Estados Unidos, é utilizada a teoria do agente principal para justificar a relação entre os juízes da Suprema Corte norte-americana e os seus assistentes. Diante das peculiaridades do sistema judicial brasileiro, o trabalho propõe uma análise crítica acerca da pertinência ou não da utilização da referida teoria para justificar a relação dos juízes com seus assistentes no Brasil.

The excess of judicial demands made the Brazilian Judiciary hire judicial assistants as one of the strategies to deal with such a large workload. Assistants assist in important stages of the decision -making process, and, in the United States the principal agent theory is used to justify the relationship between US Supreme Court judges and their assistants. In view of the peculiarities of the Brazilian judicial system, the article proposes a critical analysis about the pertinence or not of the use of that theory to justify the relationship of the judges with their assistants in Brazil.
