O artigo trata do processo de criminalização no sistema penal brasileiro e seus diversos elementos que, no final, acabam por indicar que o funcionamento do sistema é profundamente enviesado. O fato de não se saber ao certo quantos crimes ocorrem em uma dada sociedade e o foco exagerado em determinado grupo social fazem com que a criminalização no Brasil seja classista e racista, reforçando a exclusão social e ensejando o extermínio e o encarceramento de pobres e negros, principalmente jovens. Intenta-se demonstrar, com dados empíricos, a viciosa situação da questão penal no país, apontando para a urgência de um penalismo militante e transgressor, que possa transformar o inaceitável status quo.
The article deals with the criminalization process in the Brazilian penal system and its various elements that, in the end, indicate that the functioning of the system is profoundly biased. The fact that it is not known how many crimes occur on a given society and the exaggerated focus in determined social group makes criminalization in Brazil classist and racist, reinforcing the social exclusion and giving cause to the extermination and incarceration of the black and the poor, mainly young. It is intended to demonstrate, with empirical data, the vicious situation of the penal question in the country, pointing towards the urgency for a militant and transgressive penalism, which may transform the unacceptable status quo.
