Este trabalho discorre sobre as disfuncionalidades presentes no artigo 33 da Lei 11.343/2006. Argumentos iniciais são estabelecidos sobre a política mundial de guerra às drogas e acerca de suas repercussões no Direito brasileiro. Em seguida, a partir teoria da racionalidade legislativa de Diéz Ripollés, são examinadas as irracionalidades do tráfico de drogas no Brasil, diante dos cinco níveis apresentados por citada teoria. Por fim, apresentamos algumas sugestões para o aperfeiçoamento do tipo do artigo 33, tendo em vista o incremento de sua racionalidade.
This paperwork discourses about the dysfunctionalities presented by article 33, of the Statute-law 11,343/2006. There are some initial arguments concerning the war on drugs´ world politics and its repercussions on the Brazilian law. As it follows, according to the Diéz Ripollés, theory of legislative rationality, there will be examined the drug trafficking´s irrationalities, considering the five levels presented by cited theory. At the end, we will introduce some suggestions for the article 33´s improvement, aiming the increase of its rationality.
