A prova testemunhal, na maioria dos casos, é o único meio probatório ao alcance do processo penal capaz de ligar as partes e o julgador a um crime praticado. Contudo, por depender da memória humana, está suscetível a falibilidades, podendo ser contaminada tanto por fatores internos como externos à pessoa que presenciou ou vivenciou o fato delituoso. A par disso, o presente artigo tem por escopo analisar, através de pesquisas documental e doutrinária, os fatores de contaminação da memória capazes de criar falsas recordações na testemunha e repercutir no resultado da ação criminal. Será examinado o testemunho sob a perspectiva da memória humana e das falhas que pode apresentar. Estudar-se-á a formação das falsas memórias nos indivíduos, a influência que o subjetivismo do entrevistador e a mídia podem exercer sobre a memória da testemunha e a possibilidade do esquecimento da lembrança pelo transcurso do tempo. Nessa oportunidade, tratar-se-á, também, da técnica da entrevista cognitiva, vista hoje como um método eficaz, mas ainda pouco falado, na tentativa de minimizar as sugestionabilidades externas ao entrevistado e evitar a criação de falsas memórias.
The testimonial evidence, in most cases, is the unique criminal proceeding’s probationary way which is able to link the parts and the judge to a committed crime. However, as it depends on the human memory, it is susceptible to fail, and it might be contaminated both by internal and external factors to the person who witnessed or experienced the offense. Along with, the present study has the scope of analysing, through the documental and doctrinal research, the factors of memory contamination which are able to create false remembrances in the witness and to reverberate in the criminal action result. The testimonial is examined from the perspective of the human memory and the failures it can have. It is studied the individual false memory formation, the influence the interviewer and the media subjectivism may have on the witness memory, and the possibility of forgetting the remembrance due to the passing of time. In this opportunity, also the cognitive interview technique is dealt with, as it is seen nowadays as an effective method in the attempt to minimize the external suggestibility concerning the interviewee, and to avoid the false memories creation.
