O presente artigo tem como objetivo analisar, a partir de uma pesquisa empírica realizada no 1º Tribunal do Júri de São Paulo, se os objetivos declaradamente pretendidos pela Lei 13.104/2015 (Lei do Feminicídio), em uma análise preliminar, vêm sendo atendidos. Buscou-se observar a ocorrência ou não do aumento de pena aplicada aos agressores e das condenações por meio da análise comparativa dos dados estatísticos extraídos de casos anteriores e posteriores à promulgação da referida Lei. A conclusão a que se chegou é de que os objetivos não vêm sendo atendidos, motivo pelo qual propuseram-se hipóteses para as estatísticas obtidas.
The present article aims to analyze if the objectives intented by the Feminicide Law (Law 13,104/2015) are being achieved in a preliminary moment. To investigate that, the article is based on an empirical research carried out in the 1st Court of the Jury of São Paulo. It was sought to observe weather there was an increase in the number of sentences applied to cases before and after the Law’s promulgation. The results found through the extracted data indicate that the goals are not being reached, so that hypotheses are drawn in order to explain these statistics.
