A prática forense revela que a comprovação da autoria, no caso do crime de tráfico de drogas, comumente recai sobre os depoimentos de policiais. Esses depoimentos, prestados durante o inquérito policial e repetidos em juízo, sob o crivo do contraditório e da ampla defesa, terminam por ser, com frequência, a única prova de autoria a fundamentar as sentenças condenatórias, sendo-lhes atribuída presunção de veracidade que caberia ao réu desconstruir. Dessa forma, este trabalho tem como objetivo analisar em que medida a presunção de veracidade atribuída aos testemunhos de policiais no processo penal violaria o princípio da pressunção da inocência, uma vez que inverteria o ônus da prova, cabendo ao réu demonstrar a inveracidade desses testemunhos e, portanto, a sua inocência. Para tanto, foi realizada pesquisa teórica – que consistiu na análise de artigos e livros sobre o tema, tendo como marco teórico o garantismo penal; bem como pesquisa documental, que consistiu na análise de julgados do Tribunal de Justiça da Bahia, no tocante à produção de prova testemunhal no caso dos crimes de tráfico.
Forensic practice reveals that the proof of authorship, in the case of drug-trafficking crime, usually falls on the testimony of police officers. These testimonies, rendered during the police investigation and repeated in court, under the scrutiny of the contraditory and plain defense, often end up being the only proof of authorship to substantiate the convictions, being attributed a presumption of veracity that would fit the defendant deconstruct. Thus, the purpose of this study is to analyze to what extent the presumption of truth attributed to police officer testimony in criminal proceedings would violate the principle of presumption of innocence, since it would reverse the burden of proof and it is up to the defendant to demonstrate the untruthfulness of these testimonies, his innocence. For that, theoretical research was carried out – which consisted in the analysis of papers and books on the subject, having as theoretical framework the criminal principles; as well as documentary research, which consisted of the analysis of judgments of the Court of Justice of Bahia, regarding the production of testimonial evidence in the case of drug trafficking crime, as well as a report of research on false memories.
