O presente trabalho analisa uma forma específica de violência cometida em face das mulheres: a chamada pornografia tradicional. A questão central do trabalho gira em torno do fato de que, se a pornografia é uma forma de violência contra a mulher, ela se torna um problema que precisa ser tutelado pelo Direito. Com o objetivo de analisar os instrumentos jurídicos de proteção da mulher que se encontra em situação de violência em razão da pornografia, o presente artigo se estrutura em três momentos centrais. Em um primeiro momento, a pornografia tradicional é conceituada e demonstra-se como ela consiste numa modalidade de violência contra a mulher. Em um segundo momento, partindo do pressuposto de que há violência de gênero na realização e no consumo da pornografia tradicional, analisam-se os instrumentos de tutela penal existentes no ordenamento jurídico brasileiro que amparam a mulher em situação de violência. Por fim, visualiza-se a necessidade de edição de instrumentos específicos de tutela, em especial para a proteção dos direitos das mulheres que se encontram em situação de violência por causa da pornografia, à luz de iniciativas propostas no cenário estadunidense por Catharine MacKinnon e Andrea Dworkin.
The present work analyzes a specific form of violence committed against women: traditional pornography. The central issue of the work revolves around the fact that when pornography generates violence against women, it becomes a problem that needs to be carried by Law. With the aim of analyzing the legal protection instruments of women who are in a situation of violence due to pornography, this article is structured in three central moments. At first, traditional pornography is conceptualized and it is demonstrated how it generates violence against women. In a second moment, based on the assumption that there is gender violence in the making and consumption of traditional pornography, we examine the instruments of criminal protection in the Brazilian legal system that are applied to women who are in violence situation. Finally, the need for the publication of specific protection instruments, especially for the protection of the civil rights of women in situations of violence due to pornography, is addressed in the light of initiatives proposed in the United States by Catharine MacKinnon and Andrea Dworkin.
