O tema da presente investigação envolve as relações entre a teoria do jogo como elemento da cultura, do historiador holandês Johan Huizinga, e o Estado como modelo de sociedade organizada humana a partir da Idade Moderna, à luz da aplicação da teoria do Direito Penal Secundário, proposta pelo jurista lusitano Jorge de Figueiredo Dias, e sua incidência no exercício dos poderes administrativos hierárquico e disciplinar, em especial quanto ao último, diante da necessidade de prévio procedimento administrativo disciplinar na aplicação de sanções por faltas funcionais na burocracia estatal. A hipótese a ser comprovada é de que a teoria do jogo como elemento da cultura deve ser interpretada, nos limites do Estado Democrático de Direito, como desenvolvimento último do processo civilizador tardio das sociedades ocidentais, no fim do século XX. A metodologia aplicada envolve pesquisa exploratória e qualitativa, de natureza dedutiva e baseada em levantamento bibliográfico no Direito, na História e na Filosofia.

The theme of this investigation involves the relationship between the theory of game as an element of culture, by the Dutch historian Johan Huizinga, and the State as a model of organized human society from the Modern Age, in light of the application of the theory of secondary Criminal Law proposed by the Portuguese jurist Jorge de Figueiredo Dias and its impact on the exercise of hierarchical and disciplinary administrative powers, especially regarding the latter given the need for prior administrative disciplinary procedure in the application of sanctions for functional failures in the state bureaucracy. The hypothesis to be proved is that the theory of game as an element of culture should be interpreted within the limits of the Democratic State of Law as the ultimate development of the late civilizing process of Western societies, at the end of the 20th century. The applied methodology involves exploratory and qualitative research, deductive and based on a bibliographic survey in Law, History and Philosophy.
