Desde o princípio da história, as mulheres foram subjugadas e forçadas a viver em favor do homem, trabalhando como serviçais, domésticas, não podendo exercer seu papel na sociedade. A passos lentos, a sociedade foi aceitando a mulher nas suas mais diversas áreas como nos mostra a história dos movimentos feministas. Hoje, grupos feministas ainda buscam avanços no que diz respeito aos direitos reprodutivos. A legislação brasileira, por exemplo, demonstra o papel paradoxal do Estado em relação aos direitos reprodutivos principalmente no caso da mulher. Ao mesmo tempo em que impõe uma série de restrições aos procedimentos de laqueadura voluntária e penaliza o aborto, faculta ao Poder Judiciário decidir sobre casos de esterilização. Casos como esses acontecem apenas no Brasil ou outros países da América Latina também tem enfrentado dificuldades? Como o Sistema Interamericano de Direitos Humanos tem se posicionado sobre o tema? Nesse sentido, o presente artigo busca analisar a situação dos direitos reprodutivos das mulheres na América Latina. Para tanto, o artigo será dividido em três partes: a primeira parte tratará brevemente o conceito de direitos reprodutivos, a segunda parte discorrerá sucintamente sobre o histórico dos direitos reprodutivos em âmbito internacional e a terceira parte irá trazer a análise de alguns casos admitidos pela Comissão Interamericana de Direitos Humanos e algumas decisões proferidas pela Corte Interamericana de Direitos Humanos.

From the beginning of history, women were subjugated and forced to live on behalf of man, working as servants, domestic, and unable to play their role in society. At a slow pace, society has accepted women in its most diverse areas, as the history of feminist movements shows. Today, feminist groups are still seeking advances in reproductive rights. Brazilian legislation, for example, demonstrates the paradoxical role of the State in relation to reproductive rights, especially in the case of women. While it imposes a series of restrictions on voluntary tincture procedures and penalizes abortion, it allows the Judiciary to decide on cases of sterilization. Cases like these only happen in Brazil or other Latin American countries have also faced difficulties? How has the Inter-American System of Human Rights been positioned on the subject? In this sense, the present article seeks to analyze the situation of the reproductive rights of women in Latin America. To do so, the article will be divided into three parts: the first part will briefly deal with the concept of reproductive rights, the second part will briefly describe the history of reproductive rights at the international level and the third part will bring the analysis of some cases admitted by the Commission Inter-American Commission on Human Rights and certain decisions handed down by the Inter-American Court of Human Rights.
