Busca-se tratar acerca do futuro do direito consensual criminal no ordenamento jurídico brasileiro, dando-se ênfase ao estudo do instituto da colaboração premiada. Inicialmente, aborda-se a ascensão do direito consensual criminal e se analisa o contraponto entre as sistemáticas da commom law e da civil law, bem como a possível influência do instituto da plea bargaining no ordenamento jurídico brasileiro. Posteriormente, caracteriza-se o instituto da colaboração premiada, analisando sua regulamentação e a legitimidade das autoridades para firmarem acordos de colaboração premiada, bem como os poderes do magistrado acerca do mérito do acordo. Em última análise, faz-se um paralelo entre a eficiência penal garantida pelos resultados obtidos através da implementação do referido instituto e entre as garantias processuais, que podem vir a acarretar uma tensão constitucional no ordenamento jurídico pátrio.
It seeks to deal with the future of consensual criminal law in the Brazilian legal system, with emphasis on the study of the institute of award-winning collaboration. Initially, it addresses the expansion of criminal consensual law and analyzes the counterpoint between the common law and civil law systems, as well as the possible influence of the plea bargaining institute in the Brazilian legal system. Subsequently, the institute of the prize-winning collaboration is characterized, analyzing its regulation and the legitimacy of the authorities to sign agreements of prize collaboration, as well as the magistrate’s powers on the merit of the agreement. Ultimately, there is a parallel between the criminal efficiency guaranteed by the results obtained through the implementation of this institute and among procedural guarantees, which may entail constitutional tension in the legal system of the country.
