Para que se compreenda como o direito ao meio ambiente, pode ser considerado um direito fundamental é preciso estabelecer sua relação com o direito à vida, já que este se constitui como direito humano supremo. A partir do problema: o meio ambiente pela sua importância pode, de fato, ser considerado um Direito humano? , busca-se nesse artigo fazer uma reflexão acerca do tema meio ambiente, no quadro dos direitos humanos, uma vez que o meio ambiente equilibrado é essencial para a existência da vida e da saúde humana, discutindo sua importância para que se torne um direito humano. Trata-se de uma pesquisa qualitativa, de cunho bibliográfico, a partir de análise da opinião doutrinária e da legislação que dispõe sobre educação ambiental. Abordou-se a inter-relação entre o direito ao meio ambiente ecologicamente equilibrado e os direitos à vida e à saúde, enfatizando a interdependência entre todos esses direitos. Conclui que a educação ambiental, tratada de forma séria, promove a conscientização da sociedade, fazendo com que se observe a interdependência entre os direitos fundamentais.

To understand how the right to environment can be considered a fundamental right and we need to establish its relationship with the right to life, since this constitutes as supreme human righ. From the problem: the environment by its importance may, in fact, be considered a human right?, search this article make a reflection on the theme environment, within the framework of human rights, since the balanced environment is essential to the existence of life and human health, discussing its importance to become a human right. It is a qualitative research of imprint bibliographic, from the analysis of doctrinal opinion and in legislation that has on environmental education. Since method of approach was used the deductive method, as soon as it breaks of theories and general laws, such as the Federal Constitution, for specific phenomena and laws like the law 9.795 of 1.999 that has on the environmental education in Brazil. Already since method of proceeding happened a bibliographical revision of subject, from the understanding of doctrinators, between other sources. We dealt with interrelationship between the right to an ecologically balanced environment and the rights to life and health, emphasizing the interdependency between all these rights. Concludes that environmental education, treated seriously, promotes awareness of society, causing them to observe the interdependence between fundamental rights.
