A Corte Interamericana de Direitos Humanos condenou o Brasil por violação à proibição à escravidão no Caso Trabalhadores da Fazenda Brasil Verde vs. Brasil. No exercício de delimitação das responsabilidades decorrentes da proibição contida na Convenção Americana de Direitos Humanos, a Corte precisou decidir sobre o conteúdo material do direito de não ser escravizado, aplicando ao caso a Convenção de 1926 sobre escravidão, segundo a qual a escravidão é o exercício dos atributos do direito de propriedade sobre uma pessoa. A política nacional de enfretamento à escravidão e o Supremo Tribunal Federal, contudo, seguiram um caminho diferente na construção dos limites da proibição à escravidão, restringindo a proibição à escravidão no Brasil às relações de exploração laboral.
Resumo Inglês:
The Inter-American Court of Human Rights determined Brazil was liable for violation of the Article 6 of the American Convention on Human Rights. The Court at the case Brazil Verde Workers v. Brazil had to establish the scope of the right invoked, the right to not be held in slavery. Doing so, the Court defined slavery as the exercise of powers attaching to the right of ownership, defined by 1926 Slavery Convention. National policy against slavery and Brazil’s Supreme Court, however, went in a different way in regard of the limits of the prohibition of slavery, that in Brazil is related only to cases were labour exploitation is present.
