Um dos problemas da sociedade contemporânea é a questão do custo-benefício do funcionamento do Poder Judiciário: sistema de justiça lento, tribunais abarrotados de processos, pautas de audiências com longas filas de espera, inúmeros processo conclusos para julgamento, alta taxa de congestionamento etc. Em contrapartida, a magistratura brasileira reclama reconhecimento de suas funções, um novo estatuto para a carreira (medida pendente desde o advento da Constituição de 1988), reajuste salarial e novos benefícios. O que é aparentemente desproporcional torna-se ainda mais evidente se analisado de perto. A forma como o jurisdicionado brasileiro é tratado tem se mostrado inconstitucional e antidemocrática, na medida em que desrespeita os direitos e garantias fundamentais dos jurisdicionados. O problema que se propõe aqui é demonstrar que o Poder Judiciário pode “descobrir” quem é este jurisdicionado, reconhecer sua subjetividade por meio de uma perspectiva dialética da alteridade. Nesse ponto, o papel dos atores jurídicos é de fundamental importância para, a partir da posição do “Outro”, construir um mundo de novas possibilidades.
One of the problems of contemporary society is the issue of cost-effectiveness of the functioning of the Judiciary: slow justice system, crowded courts of proceedings, waiting lists with long queues, countless trial cases, high congestion and etc. In contrast, the Brazilian judiciary demands recognition of its functions, a new statute for the career (measure pending since the advent of the 1988 constitution), salary adjustment and new benefits. What is seemingly disproportionate becomes even more evident if analyzed closely. The way in which Brazilian courts are treated has been unconstitutional and undemocratic, insofar as they violate the fundamental rights and guarantees of the courts. The problem that is proposed here is to demonstrate the importance of the Judiciary to “discover” who is this jurisdiction, to recognize its subjectivity through a dialectic perspective of otherness. At this point the role of legal actors is of fundamental importance to build a world of new possibilities from the position of the Other.
