Considerando-se a inegável importância da educação nas transformações sociais que se deseja para o país, objetiva-se analisar o direito social à educação em seu contexto de surgimento, evolução e efetivação. Para tanto, procede-se ao estudo, através da metodologia histórica e documental, das determinações constitucionais e infraconstitucionais sobre o tema, bem como à análise das interpretações decorrentes de tais normas. Desse modo, observa-se que a educação é um direito cuja efetivação depende de medidas concretas, o que permite concluir que o Brasil precisa dar ao tema o papel de prioridade que lhe é merecido, o quanto antes.

Considering the undeniable importance of education in the social transformations desired for the country, it aims to analyze the social right to education in its context of emergence, evolution and effectiveness. In order to do so, we study, through historical and documentary methodology, the constitutional and infraconstitutional determinations on the subject, as well as the analysis of interpretations resulting from such norms. In this way, it can be observed that education is a right whose implementation depends on concrete measures, which leads to the conclusion that Brazil needs to give the theme its priority role, as soon as possible.
