O Brasil aproxima-se da comemoração dos 200 anos de sua fundação política. Na construção de um projeto de desenvolvimento, hoje, sustentável para o Brasil, em sua inserção regional e internacional, o Direito tem de desempenhar uma função extremamente importante, porque é por meio dele que o vocabulário das demais ciências torna-se efetivo, por meio de normas e instituições. A ordem do espaço público decorre dessa conversão e a inserção da política no Direito é que permite a elevação à Democracia daquilo que o Direito apenas concebia como seu império ou rule of law, e como arcabouço de proteção dos imprescindíveis e inafastáveis Direitos Humanos. Cabe ao Direito, como ciência e como prática, tornar efetivos esses direitos fazendo a constante migração entre os espaços internacional e interno, e conjugando-os com os imperativos da participação efetiva e da representação legítima, no seio de estruturas jurídicas que façam fluir os signos de uma sociedade política realmente democrática.
Resumo Inglês:
Brazil is approaching the 200th anniversary of its political foundation. In the construction of a development project, today, sustainable for Brazil, in its regional and international insertion, the Law has to play an extremely important function, because it is through it that the vocabulary of the other sciences becomes effective, through standards and institutions. The order of the public space results from this conversion and the insertion of politics in Law is what allows the elevation to Democracy of what Law only conceived as its empire or rule of law, and as a framework for the protection of the indispensable and inexhaustible Human Rights. It is up to the Law, as a science and as a practice, to make these rights effective by making the constant migration between the international and domestic spaces, and combining them with the imperatives of effective participation and legitimate representation, within legal structures that make the signs flow of a truly democratic political society.
