A extinção do efeito suspensivo nas apelações do Tribunal do Júri, proposta pelo Ministério da Justiça e Segurança Pública, tende a tornar o recurso ineficaz. A jurisprudência, ao contrário do que defende a doutrina, jádemonstra uma ruptura na devolução dessa apelação. Diante disso,o artigo defende que a extinção de outro efeito recursal criará uma exceção materialà regra principiológica do duplo grau de jurisdição.
The revocation of the suspensive effect on appealsabout the Jury Court, proposed by the Ministry of Justice and Public Security, tends to turn the appeal ineffective. The jurisprudence, unlike to what the doctrine argues, shows already a break in theappeals’ return effect.Given this, the article argue that the extinction of another appeal’s effect will create a material exception to the principled rule of the double degree of jurisdiction.
