Resumo: O objeto de análise da presente investigação é a fundamentação da culpabilidade jurídico-penal. O objetivo é analisar em que medida o conceito de reconhecimento pode contribuir para a construção de uma fundamentação ético-social da culpabilidade jurídico-penal pós-finalista não funcionalista. A hipótese é que este conceito desempenha um papel central nesta construção, sobretudo em relação à significação da liberdade individual. A base teórica com a qual se pretende verificar a possibilidade desta construção é representada pela filosofia social produzida pela Escola de Frankfurt.
Abstract: The object of analysis of this research is the fundaments of the criminal culpability. The objective is to analyze to what extent the concept of recognition can contribute to building an ethical-social fundaments for a post- finalist not functionalist criminal culpability. The hypothesis is that this concept plays a central role in this construction, particularly in relation to the meaning of individual freedom. The theoretical basis with which to check the possibility of this construction is represented by the Social Philosophy produced by the Frankfurt School.
