O presente estudo lança o olhar sobre o depoimento especial de crianças e adolescentes a partir da Lei 13.431/2017. Tem por objetivo analisar a compatibilidade constitucional do instituto, deficiências da legislação e as possibilidades de desvios operativos em razão da cultura autoritária e punitiva. A análise será centrada na produção e na valoração do depoimento. O recorte adotado será o depoimento especial e sua regência na Lei 13.431/2017, ficando a questão da escuta especializada e a Lei 13505/2017 como meras indicações tangenciais que merecerem investigação específica.
The present study looks at the special testimony of children and adolescents from Law 13,431/2017. Its purpose is to analyze the constitutional compatibility of the institute, deficiencies of the legislation and the possibilities of operational deviations due to the authoritarian and punitive culture. The analysis will focus on the production and the valuation of the testimony. The cut adopted will be the special testimony and its regency in Law 13.431/2017, with the issue of specialized hearing and Law 13.505/2017 as mere tangential indications that warrant specific investigation.
