A “Lei Maria da Penha” e a Lei do Feminicídio tracejam-se como triunfos da bandeira feminista brasileira que, desde a década de 1970, reivindica ante o Estado políticas que aufiram salvaguarda às mulheres como corolário de um país machista, patriarcal e perpetuador de disparidades de gênero e violência contra a mulher. Imiscuindo-se às ponderações da criminologia feminista enquanto marco teórico, bem como possuindo como metodologia a pesquisa exploratória de cariz bibliográfico e documental, este trabalho detém como escopo explanar a significância que a “Lei Maria da Penha” e a Lei do Feminicídio possuem, ainda que sejam legislações simbólicas e detentoras de paradoxos provenientes tanto de suas próprias naturezas quanto de suas instrumentalizações e operacionalizações pelas instituições do sistema de justiça criminal. Assim, a aptidão em publicizar a violência contrária à mulher, inserir esse debate na ordem social e na agenda política, bem como compreender as violências como fenômenos de natureza estrutural, são dimensões notáveis e meritórias que as legislações trouxeram consigo.
The “Maria da Penha Law” and the Feminicide Law are triumphs of the Brazilian feminist flag, which, since the 1970s, claims before the State policies that have safeguarded women as a corollary of a macho, patriarchal and perpetuating country of gender disparities and violence against women. Taking into account the considerations of feminist criminology as a theoretical framework, as well as having as a methodology the exploratory research of bibliographic and documentary nature, this work has as its scope to explain the significance that the “Maria da Penha Law” and the Law of Feminicide possess, even though they are symbolic legislations that hold paradoxes from both their own natures and their instrumentalizations and operationalizations by the institutions of the criminal justice system. Thus, the ability to publicize violence against women, to insert this debate in the social order and the political agenda, as well as to understand violence as phenomena of a structural nature, are remarkable and meritorious dimensions that the laws brought with them.
