O presente artigo tem por objetivo refletir sobre o efeito simbólico da Lei 14.321/2022 – Lei da Violência Institucional e demonstrar as falhas em sua aplicação simbólica para compreender os reflexos das normas penais simbólicas no que diz respeito à violência institucional, estudando a trajetória do sistema penal em defesa ao direito da mulher, em especial a violência de gênero. A abordagem utilizada na pesquisa tem como suporte ao método dedutivo, utilizando-se de metodologias de pesquisa bibliográfica, documental e análise de estudos anteriores realizados pela Autora. Os resultados indicam que a violência institucional contra as mulheres é uma realidade presente tanto no cotidiano social quanto nas organizações, incluindo aquelas que têm a obrigação de proteger os direitos humanos, como o Poder Judiciário. No entanto, essa violência permanece muitas vezes invisível, aparecendo nas notícias apenas esporadicamente como eventos extraordinários. Isso evidencia a necessidade urgente de promover discussões efetivas, reflexões e a exigência de ações concretas por parte das organizações. Além disso, é crucial fomentar debates acadêmicos, sociais e institucionais voltados para a mudança de comportamentos enraizados em uma sociedade patriarcal, em vez de criar legislações simbólicas que, devido à sua aplicação ineficaz, geram insegurança na sociedade e não reduzem a criminalidade e a violência de gênero.
This article aims to reflect on the symbolic effect of Law 14.321/2022 – the Law on Institutional Violence – and demonstrate the flaws in its symbolic application in order to understand the repercussions of symbolic penal norms regarding institutional violence, studying the trajectory of the penal system in defense of women's rights, especially gender-based violence. The research approach is based on the deductive method, using bibliographic and documentary research methodologies and analysis of previous studies conducted by the author. The results indicate that institutional violence against women is a present reality both in everyday social life and in organizations, including those that have the obligation to protect human rights, such as the Judiciary. However, this violence often remains invisible, appearing in the news only sporadically as extraordinary events. This highlights the urgent need to promote effective discussions, reflections, and the demand for concrete actions on the part of organizations. Furthermore, it is
crucial to foster academic, social, and institutional debates aimed at changing behaviors rooted in a patriarchal society, rather than creating symbolic legislation that, due to its ineffective application, generates insecurity in society and does not reduce crime and gender-based violence.
