In the latest six years, we have resized the discurse thanks to the internet and social networks. But at the same time, we have fallen into the punishment of hate speech, that has led its authors to the National Court. The objective of this paper is to review the latest cases and adjust them to a restricted concept of hatred, both in the criminal code and in their application in the courts.
En los últimos años asistimos a una redimensión del discurso en general gracias a internet y las redes sociales. Con ello, hemos caído en el castigo del discurso de odio discrepante, de un discurso molesto que ha llevado a sus autores ante la Audiencia Nacional. El objetivo de este trabajo es revisar los últimos casos y ajustarlos a un concepto restringido de odio, tanto en los preceptos penales como en su aplicación en los tribunales.
