Este trabalho científico tem por objetivo identificar espaços e avaliar a possibilidade de derivação de casos envolvendo violência doméstica e familiar contra a mulher à justiça restaurativa. Primeiramente, a partir de pesquisa teórica e bibliográfica, analisa-se a justiça restaurativa como mecanismo de solução de situações problemáticas, com especial exame dos desafios contemporâneos traçados pela literatura especializada a partir da experiência brasileira concentrada no Poder Judiciário. No âmbito da violência contra a mulher, com base em pesquisa histórico-jurídica, traça-se a evolução do tratamento legal dispensado a essas situações problemáticas, que, mesmo em tempos atuais, revela-se insuficiente para interrupção do ciclo de violência contra a mulher. Em análise de pesquisas empíricas, identificam-se projetos de justiça restaurativa que revelam experiências exitosas de empoderamento da mulher, assun-ção de responsabilidade de agressores e cessação do processo de revitimização. Não obstante se reconheça a intensa resistência oposta pelo setor feminista ao manejo da justiça restaurativa, tem-se que, quando pautada e construída a partir de viés feminista, mediante eleição de filtros de segurança, a formulação restaurativa oferece potencialidades e ferramentas distintas de enfrentamento à violência doméstica e familiar contra a mulher.
This scientific work aims to identify spaces and evaluate the possibility of referral of cases involving domestic and family violence against women to restorative justice. First, from a theoretical and bibliographical research, restorative justice is analyzed as mechanism for solving problematic situations, including examination of the contemporary challenges traced by the specialized literature based on the Brazilian experience concentrated in the Judiciary. In the context of the violence against women, based on a historical-juridical research, it is traced an evolution of the legal treatment of these problematic situations, which, even in current times, reveals to be insufficient to interrupt the cycle of violence against women. Analyzing empiric research, it is identified projects of restorative justice which reveal successful experiences of women’s empowerment, offender accountability and cessation of the revictimization process. Despite the strong resistance of the feminist sector to the handling of restorative justice, it must be pointed out that, when based and constructed from the feminist perspective, through the selection of safety filters, the restorative formulation offers distinct potentialities and tools to confront the domestic violence against women.
