O texto analisa o acesso à saúde no sistema prisional brasileiro. Busca situar o grau de efetividade do direito social à saúde na estrutura carcerária, na qual sua manutenção é mais delicada e desvalorizada. A pesquisa exibe dispositivos jurídicos sobre o caráter fundamental do acesso à saúde e estabelece os contornos da efetividade. Ainda, expõe informações das condições de saúde das pessoas presas. Por fim, relaciona o direito à saúde e a situação expressa pelos dados examinados. A pesquisa utiliza a metodologia dedutivo-analítica, pois desenvolve o texto com o estabelecimento das normas jurídicas gerais e abstratas e sua relação com as informações apresentadas. O método bibliográfico posiciona as teorias e os aportes jurídicos relacionados ao objeto da pesquisa. A coleta de dados localiza de forma fática os problemas do acesso à saúde no Brasil.
The text analyzes the access to health in the Brazilian prison system. It seeks to situate the level of effectiveness of the social right to health in the prison structure, where its maintenance is more delicate and devalued. The research shows legal standards about the fundamental nature of access to health and establishes the contours of its effectiveness. Also exposes information about the health of prisoners. Finally, it relates the right to health to the situation expressed by the data information. The research uses deductive-analytic approach for developing the text with the establishment of general and abstract legal rules and its relation to the information presented. The bibliographic method relates theories and legal contributions to the research object. The data collection presents the problems of access to health in Brazil.
