O presente artigo tem como objetivo analisar o instituto da (in) fidelidade partidária no Brasil. Primeiramente serão apresentadas as principais causas da infidelidade partidária no contexto político nacional. Em segundo lugar, analisar-se-á o entendimento dos tribunais superiores nesta matéria e, por fim, quais são as consequências que o alto índice de infidelidade partidária pode causar na democracia que por ora ainda se afigura em desenvolvimento, bem como tratar de tecer algumas sugestões com o objetivo de estancar o suposto problema. A pesquisa, de caráter qualitativo, é realizada sobre a base bibliográfica-documental. Quanto à pesquisa bibliográfica, ela oferece o suporte necessário para a compreensão de conceitos, teorias e sobre o funcionamento das instituições políticas. Já a pesquisa documental busca enfatizar o estudo da legislação referente ao tema proposto. Ademais, foram realizadas pesquisas doutrinárias e jurisprudenciais no âmbito dos tribunais superiores encarregados de julgar a matéria, tais como o supremo tribunal Federal e o tribunal superior Eleitoral. Com base nos estudos da infidelidade partidária no Brasil, a troca frequente de partidos reforça uma situação de falta de identidade partidária, razão pela qual inexiste qualquer identificação do candidato com programas partidários e o eleitor acaba votando no indivíduo de sua preferência. Isso ressalta que os partidos não são condições indispensáveis para a geração de oportunidades de carreira política.

This article aims to analyze the institute of (in) party loyalty in Brazil. First, the main causes of party infidelity in the national political context will be presented. secondly, it will analyze the understanding of the High Courts in this matter and, finally, what are the consequences that the high rate of party infidelity can cause in the democracy that still seems to be developing, as well as try to weave some suggestions with the purpose of stopping the supposed problem. the research, of a qualitative nature, is carried out on the bibliographic-documentary basis. As for bibliographic research, it provides the necessary support for the understanding of concepts, theories and the functioning of political institutions. Already, the documentary research, seeks to emphasize the study of the legislation regarding the proposed theme. In addition, doctrinal and jurisprudential investigations were carried out in the scope of the superior Courts in charge of judging the matter, such as the Federal supreme Court and the superior Electoral Court. Based on the studies of partisan infidelity in Brazil, the frequent exchange of parties reinforces a situation of lack of partisan identity, reason why there is no identification of the candidate with party programs and the voter ends up voting in the individual of his preference. this emphasizes that parties are not indispensable conditions for the generation of political career opportunities.
