O presente artigo pretende estudar a efetividade da Lei de Execução Penal através de uma análise que perpassa a teoria do garantismo, a filosofia política de Agamben e o conceito de história de Walter Benjamim. O ponto de partida é o que se chamou de “arquitetura da execução penal”, precisamente a edificação penal, ou seja, o espaço organizado para a execução da pena. Busca-se daí observar as estruturas de Poder, pois, é nos limites do espaço territorial que a dominação é exercida e onde existe a soberania do poder. O trabalho se estrutura a partir das normas que regulam a execução penal, passando por uma reflexão sobre a relação do ser e do dever ser à luz do garantismo penal de Ferrajoli, para chegar à apresentação dos dados levantados no Instituto Penal Plácido de Sá Carvalho ilustrando a categoria “campo de concentração” como paradigma do poder na perspectiva de Giorgio Agamben. Por fim, o estudo busca desvelar para o âmbito da execução penal a tomada de consciência, com a contribuição de Walter Benjamin sobre a necessidade de se fundar verdadeiramente o estado de exceção, ousando ainda apresentar algumas propostas paliativas de sobrevivência do sistema enquanto se espera o seu sonhado fim.
The present article intends to study the effectiveness of the Law of Penal Execution through an analysis that goes through the theory of Garantism, the political philosophy of Agamben and the concept of history of Walter Benjamim. The starting point is what was called the “architecture of criminal execution”, precisely the criminal construction, that is, the space organized for the execution of the sentence. As we seek to observe the structures of Power, therefore, it is within the limits of the territorial space that domination is exercised and where there is the sovereignty of power. The work is structured from the norms that regulate the criminal execution, passing through a reflection on the relation of the “being” and the “duty to be” in the light of the criminal garantism of Ferrajoli, to arrive at the presentation of the data collected in the Criminal Institute Plácido de Sá Carvalho illustrating the category “concentration camp” as paradigm of power in the perspective of Giorgio Agamben. Finally, the study seeks to unveil to the scope of criminal execution the awareness, with the contribution of Walter Benjamin on the need to truly establish the state of exception, daring to present some palliative proposals for survival of the system, while waiting for your so dreamed end.
