Objetivo: discutir a aplicação de exames preventivos no trânsito e a possível violação dos Princípios da Isonomia, Privacidade e da Não Autoincriminação. Materiais e Métodos: o trabalho foi feito através de uma pesquisa bibliográfica e o seu desenvolvimento tem caráter de natureza qualitativa e característica explicativa. Foram usados, como fontes, artigos científicos, legislações positivadas e obras doutrinárias pertinentes ao tema. O artigo procurou analisar a aplicação dos princípios da Isonomia, Privacidade e da Não Autoincriminação relacionados com os exames de alcoolemia e toxicológico, tendo como resultado a possível violação desses princípios. Resultados: o exame toxicológico fere o princípio da Isonomia pela forma distinta como são tratados os condutores das categorias de habilitação C, D e E das demais categorias, fere o da Privacidade pela forma como é realizado o exame e, em relação a não Autoincriminação, o princípio tem o seu direito violado pelo exame toxicológico e o de alcoolemia, pois a aplicação dos dois exames se inclina a uma possível incriminação contra si pelo cidadão. Considerações Finais: é possível compreender que os exames de Alcoolemia e Toxicológico inclinam-se para a violação dos princípios constitucionais destacados no artigo, por se tratarem de algo que repercute no trânsito, gerando discussões referente à sua aplicabilidade e constitucionalidade.

Objective: to discuss the application of preventive exams in traffic and the possible violation of the Principles of Isonomy, Privacy and NonSelf-Injury. Materials and Methods: the work was done through a bibliographical research and its development has qualitative character, with explanatory characteristic, were used as sources scientific articles, positive legislation and doctrinal works pertinent to the theme. The article sought to analyze the application of the principles of Isonomy, Privacy and Non-Self-Injury related to alcohol and toxicology examinations, resulting in a possible violation of these principles. Results: the toxicological examination violates the principle of Isonomy by the different way in which drivers of the categories C, D and E are treated, of the other categories, it hurts Privacy by the way in which the examination is carried out, and in relation to Non-Self-Injury, the principle has its right violated by the toxicological examination and the blood alcohol test, since the application of the two examinations is inclined to a possible incrimination against him by the citizen. Final Considerations: it is possible to understand that the exams of Alcohol and Toxicological incline to the violation of the constitutional principles highlighted in the article, because they are something that affects the transit generating discussions regarding its applicability and constitutionality.
