O presente trabalho busca analisar o cárcere feminino, especificamente no caso de mulheres que estejam passando pela maternidade na prisão, recaindo sobre a recente alteração do Código de Processo Penal promovida pelo Estatuto da Primeira Infância (Lei 13.257/2016), no que tange a prisão domiciliar em substituição à prisão preventiva. Tratou-se da questão da prisão domiciliar no campo da execução penal e sua limitação somente para aquelas mulheres que se encontram em regime aberto. Perquire-se a possibilidade de deferimento do benefício às prisioneiras que se encontram nos regimes semiaberto e fechado.
The present work seeks to analyze the female prison, specifically in the case of women who are going through maternity in prison, it was analyzed the recent amendment of the Code of Criminal Procedure promoted by the Estatuto da Primeira Infância in relation to the house arrest in substitution for the preventive custody. It was the issue of house arrest in the field of criminal enforcement and its limitation only to those women who are in the open regime. The question is whether the possibility of granting the benefit to the prisoners in the semi-open and closed regimes is possible.
