In this essay, the border relationship between the legislation concerns the right to formal education and the rights of children / adolescents hospitalized discussed. The debate started by the original question about the power which the State exercises this specific audience. Our argument is based on the idea of Agamben on his concept of state of emergency, and what the philosopher understands this concept have been at the center of the structure of contemporary states. The hypothesis that the law school should be guaranteed regardless any questioning a priori, any scientific distrust remains hidden forms and that the State is reinforced at every step of the neoliberal development, increasingly delineated logic control and empowerment the individual. In this brief essay, he sought a profound study of this hypothesis in the context of the Brazilian experience on hospital education.

En este ensayo se discute la relación entre la legislación que se refiere al derecho a la educación regular y los derechos del niño/adolescente hospitalizado. El debate se inició por medio de la cuestión original a respecto del poder que el Estado ejerce sobre este público en especÃfico. Nuestro argumento se basó en la idea de Agamben sobre los conceptos de Estado de Excepción y biopolitica, y de lo que el filósofo entiende sobre estos conceptos haber ocupado el centro de la estructura de los Estados contemporáneos. La hipótesis de que el derecho a la escuela se debe garantizar prescindiendo cualquier cuestionamiento a priori, cualquier desconfianza cientÃfica, mantiene ocultas las formas que el Estado encuentra y refuerza, a cada paso del desarrollo neoliberal, su lógica cada vez más delineada de control y apoderamiento del individuo. En este breve ensayo se buscó profundizar esta hipótesis dentro del contexto de la experiencia brasileña sobre la educación hospitalaria.
