Busca-se um maior entendimento a respeito da importância da aplicação dos direitos fundamentais nas relações entre particulares, sendo necessário que se leve sempre em consideração as regulamentações trazidas pela Carta Magna. A proeminência dos direitos fundamentais na seara do Direito Privado é fenômeno inevitável, fruto da universalidade dos conceitos. As discussões acerca da maneira em que os direitos fundamentais teriam influência na relação inter privatos tiveram seus primórdios no século XX, na Alemanha. No Brasil, o assunto vem sendo tratado pela doutrina constitucional recentemente, analisando a sua crescente incidência e eficiência no ordenamento jurídico.

It aims at a better understanding of the importance of the application of fundamental rights in relations between individuals, being necessary to always take into account the regulations brought by the Brazilian Constitution. The prominence of fundamental rights in the mobilization of private law is unavoidable phenomenon, the result of the universality of concepts. The discussions about the way in which fundamental rights would influence the Inter- privatus relationship had their beginnings in the twentieth century in Germany. In Brazil, the issue is being addressed by recent constitutional doctrine, analyzing its increasing incidence and efficiency in the legal system.
