O presente trabalho tem por objetivo fazer um estudo do discurso jurídico, enfatizando na questão a respeito da eficácia dos direitos fundamentais. Assume, portanto, repercussão na área jurídica, já que a exigibilidade de um direito faz parte do processo de construção da cidadania e do Estado Democrático de Direito e para que esse acesso à justiça seja efetivado é necessário que os titulares dos direitos e deveres que necessitam se apropriar do debate, conhecendo, portanto os seus limites e seus alcances.
Resumo Inglês:
This paper aims to study the legal discourse, emphasizing the question about the effectiveness of fundamental rights. It assumes, therefore, repercussion in the legal area, since the enforceability of a right is part of the process of construction of citizenship and the Democratic State of Law and for this access to justice to be effective, it is necessary that the holders of rights and duties that they need to take ownership of the debate, knowing its limits and its scope.
