O artigo tem por escopo analisar o desenvolvimento histórico-dogmático do dolus indirectus e, a partir daí, conectar o conceito aos problemas contemporâneos da imputação subjetiva e da normativização do dolo, especificamente no que se refere à compatibilização do dolo com o desconhecimento fundado na indiferença, de lege lata ou de lege ferenda.
The aim of this paper is to analyze the historical-dogmatic development of dolus indirectus and, from this point of view, to connect the concept to the contemporary problems of subjective imputation and dolus’ normativization, specifically regarding the compatibility of dolus with ignorance based on indifference, in lege lata or lege ferenda.
