O artigo questiona o caráter substancialista e antigarantista dos artigos 241-B e 241-C da Lei 8.069/90. A criminalização da mera posse de pornografia infantil e principalmente a criminalização da simulação de pornografia infantil apontam muito mais para uma intolerância dos desejos perversos, sustentada por referências eminentemente morais, do que para uma tutela efetiva de direitos fundamentais. As fantasias, por mais abjetas que sejam, não devem ser objeto de tutela penal, pois por si só não são capazes de gerar lesão. Em uma perspectiva garantista, ninguém deve ser punido pelo que é ou pelo que sente, pois proceder dessa forma faz o direito penal recair no – historicamente conhecido – “direito penal de autor”, gerando uma confusão muitas vezes irreparável entre direito e moral. Isso, além de dar azo à conhecida “doutrina de defesa social”, dá também ao direito penal poder ilimitado de atuação, negando sua própria razão de ser, com consequências políticas inimagináveis quanto ao seu uso.
The article questions the substantialist and antigarantistic character of the articles 241-B and 241-C of the Lei 8.069/90. The criminalization of the mere possession of child pornography and mainly the criminalization of the simulation of child pornography points mostly towards a intolerance regarding perverted desires, sustained by eminently moral references, than towards a effective guardianship of fundamental rights. The fantasies, as abject as they are, shouldn’t be object of penal guardianship, because by themselves they are not capable of generating lesions. In a garantistic perspective, no one should be punished for who they are or for what they feel, because proceeding this way makes the criminal law relapse in the – historically known – “criminal law of the author”, generating a confusion many times irreparable between law and morals. This, besides leading to the known “social defense doctrine”, gives to the criminal law unlimited acting power, negating its proper reason of being, with unimaginable political consequences regardind its use.
