Este artigo tem por objetivo apresentar o significado dos direitos humanos e o processo de (des)construção de seu conceito ao longo dos anos no Brasil. Fruto de conquistas e lutas históricas, os direitos humanos referem-se a um conjunto de direitos, tais como o direito à vida, à liberdade, à alimentação, ao trabalho, dentre outros, que fundamentam uma existência digna ao longo da história. Sua efetivação na ordem internacional se deu a partir do final da Segunda Guerra Mundial, com a promulgação da Declaração Universal dos Direitos Humanos (DUDH), em 1948, pela Organização das Nações Unidas (ONU). A referida declaração preconiza a defesa pelos direitos pertencentes à toda pessoa humana, independente de nacionalidade, raça, sexo, religião ou qualquer outra característica. No Brasil, os direitos humanos estão contidos na Constituição Federal de 1988 como “direitos fundamentais”, que corresponde àqueles referentes aos direitos reconhecidos e positivados pelo Estado. No entanto, desde a redemocratização brasileira, na década de 1980, o significado de direitos humanos vem sido trabalhado por um processo de desinformação e distorção enganosa, na tentativa de incutir na sociedade a ideia de que direitos humanos são “direito de bandidos”, ou outras formas pejorativas de denominação, o que em nada condiz com seu real significado. Em termos metodológicos, este artigo corresponde a um estudo de revisão, categorizado como pesquisa qualitativa (quanto à natureza), descritiva (quanto ao objetivo) e bibliográfica (quanto ao objeto).
This article aims to present the meaning of
human rights and the process of
(de)construction of its concept over the years in
Brazil. The result of historical conquests and
struggles, human rights refer to a set of rights,
such as the right to life, liberty, food, work,
among others, that underlie a decent existence
throughout history. Its implementation in the
international order took place at the end of
World War II, with the promulgation of the
Universal Declaration of Human Rights
(UDHR), in 1948, by the United Nations (UN).
The declaration advocates the defense of the
rights belonging to every human person,
regardless of nationality, race, sex, religion, or
any other characteristic. In Brazil, human rights
are contained in the Federal Constitution of
1988 as “fundamental rights”, which correspond to those referring to rights
recognized and affirmed by the State. However,
since the Brazilian democratization, in the
1980s, the meaning of human rights has been
worked through a process of misinformation
and misleading distortion, to instill in society,
the idea that human rights are "the right of
bandits”, or other pejorative forms of
denomination, which is in no way consistent
with its real meaning. In methodological terms,
this article corresponds to a review study,
categorized as qualitative (in terms of nature),
descriptive (in terms of objective) and
bibliographical (in terms of object) research
