Com a teoria cognitiva do dolo, reviveu-se a discussão sobre a exigência da vontade para a configuração da conduta dolosa. O presente artigo, a partir de uma perspectiva deslegitimante do poder de punir, propõe-se a uma análise de tal teoria. Para tanto, toma como ponto de partida o questionamento sobre o que significa essa teoria em termos de severidade punitiva e trabalha com a hipótese de que a abdicação da vontade no dolo representa um aumento irracional de repressão punitiva.
As the cognitive theory of the dolus appeared, the discussion about demanding purpose to affirm the dolus was reborn. The present article, from a perspective that denies the legitimacy of the punitive power, intends to analyse this theory. For that, it begins questioning the punitive harshness in this theory and establishes the hypothesis that supressing the intent of the dolus analysis is an irrational increase in the criminal punishment.
