O presente trabalho pretende analisar a relevância dos comportamentos alternativos conforme ao direito para a verificação da realização do risco no resultado. Para tanto, parte-se da contextualização do problema proposto e, em seguida, procede-se à confrontação das construções dogmáticas desenvolvidas para a solução da problemática por meio da verificação da eficácia da proibição da conduta, sob uma perspectiva ex post, para a proteção do bem jurídico.
The present paper intends to analyze the relevance of alternative behaviors according to the law to verify the realization of risk in the outcome. To do so, it starts from the contextualization of the proposed problem and, then, it proceeds to confront developed dogmatic constructions to solve the problem by verifying the effectiveness of the prohibition of conduct, under an ex post perspective, for the protection of the legal interest.
