O presente estudo tem como objetivo geral descrever o conceito e a evolução histórica da paternidade socioafetiva e valeu-se do método de abordagem dedutivo e do método de investigação bibliográfico, com acesso às legislações, as doutrinas e às jurisprudências Pátria referente ao tema. Tem-se a título de objetivos específicos, verificar o conceito doutrinário de paternidade socioafetiva e identificar a sua evolução histórica, bem como indicar os elementos de configuração da posse de estado de filho. As relações familiares estão sendo reescritas com os valores principiológicos e axiológicos emanados da atual Constituição Federal e os novos ventos prestigiam o ser humano e os seus sentimentos. Filhos ilegítimos, incestuosos, legitimados e outras denominações puramente discriminatórias foram enterrados, hodiernamente, filho é somente filho, não importa a sua origem.
The purpose of this study is to describe the concept and historical evolution of socio-affective paternity, using the method of deductive approach and method of bibliographic research, with access to legislation, doctrines and jurisprudence. The specific objectives are to verify the doctrinal concept of socio-affective paternity and to identify its historical evolution, as well as to indicate the elements of configuration of possession of the son state. Family relations are being rewritten with the principles and axiological values emanating from the current Federal Constitution and the new winds prestige the human being and his feelings. Illegitimate, incestuous, legitimized children and other purely discriminatory denominations were buried, nowadays, son is only child, no matter their origin.
