O trabalho propõe uma análise sobre a aplicação do instituto da Colaboração Premiada contraposto a sua suposta invalidade diante dos princípios e garantias defendidos pela Constituição Federal. Para isso, foi realizada pesquisa a periódicos acadêmicos, livros, artigos científicos e análise da lei 12.850/13, por meio de procedimento objetivo, passível de demonstrações e comparações, cujo escopo será a busca da verdade real e material, de modo a conhecer, interpretar e concluir a efetividade do objeto em estudo. Verificou-se, com este estudo, que a colaboração premiada caracteriza-se por ser um instrumento que objetiva auxiliar o Poder Judiciário nas investigações dos crimes cometidos por organizações criminosas, onde o agente colaborador tem direito a benefícios processuais em troca de suas valiosas informações na elucidação de crimes graves, em face da manutenção da segurança jurídica.
Resumo Inglês:
The paper proposes an analysis on the application of the Institute of the Prize Collaboration, against its alleged invalidity in view of the principles and guarantees defended by the Federal Constitution. For that, a research was conducted to academic journals, books, scientific articles and analysis of law 12.850 / 13, through an objective procedure, capable of demonstrations and comparisons, whose scope will be the search for real and material truth, so as to know, Interpret and conclude the effectiveness of the object being studied. It was verified with this study that the award-winning collaboration is characterized by being an instrument that aims to assist the Judiciary in investigating crimes committed by criminal organizations, where the collaborating agent is entitled to procedural benefits in exchange for his valuable information in the Elucidation of serious crimes, in view of the maintenance of legal certainty.
