Resumo Português:
O objeto do presente trabalho, tem por objetivo
o estudo do requisito de miserabilidade, ou seja,
do critério econômico, que é um dos requisitos
necessários para obtenção do direito ao
Benefício de Prestação Continuada, que traz os
parâmetros necessários para obtenção do direito
ao amparo financeiro da referida lei. Dúvidas
acerca da constitucionalidade do referido
critério, tendo por base as mudanças sociais e
das condições de subsistência individual, a
necessidade de uma flexibilização do quesito
econômico se mostram de grande necessidade,
em vista da real condição econômica atual de
quem se encontra em situação de maior
vulnerabilidade financeira. Diante disso,
analisa-se um relativo "confronto" entre os
métodos de avaliação utilizados pelo INSS,
responsável pela avaliação, concessão e
manutenção do benefício no âmbito
administrativo, que utiliza-se a risca do critério
estipulado pela Lei Orgânica de Assistência
Social, ou seja, renda per capita inferior a ¼ do
salário mínimo federal e a flexibilização
formada pelas jurisprudências dos Tribunais e
Juizados.
