O presente estudo trata, a partir da leitura de autores críticos em relação à ciência do direito e as ciências sociais, da função social do estudante de direito frente ao “fascismo social” resultado da sociedade globalizada e da prática de assessoria jurídica popular nas comunidades periféricas. O estudo formou-se a partir da análise bibliográfica de pesquisas em relação à temática, permeia desde os fatores e efeitos nefastos do processo de globalização até o seu modo de manifestação política através do direito. Destacamos ainda, como a ciência jurídica, desde os bancos de ensino até mesmo as práticas retóricas dos tribunais legitimam e/ou pouco fazem para mudar esta situação. Culminando ao final com a sugestão dos trabalhos de assessoria jurídica popular universitária como alternativa a esta situação fatídica, Tanto criando espaços de resistência e enfrentamento pelas camadas oprimidas pelo processo globalizante hegemônico, como pela luta de mudança no paradigma jurídico de ensino e prática do direito.

The present study treats, starting from the critical authors' reading in relation to the science of the right and the social sciences, Of the social function of the student of right front to the "social fascism", result of the global society and of the practice of popular juridical consultantship in communities of the periphery. The study was formed starting from the bibliographical analysis and of researches in relation to the themes that it permeates factors and disastrous effects of the globalization process to the way of political manifestation through the right. It still highlights, as the juridical science, from the teaching banks to the rhetorical practices of the tribunals that legitimate and/or little does to change this situation. It culminates at the end suggestion of works of popular juridical consultantship academical as alternative the this fatidical situation, creating resistance spaces and of confrontatio for the oppressed layers for the global process hegemonic, as for the fight of changes in the juridical paradigm of teaching and practice of the right
