A UNIÃO ESTÁVEL NO ATUAL CONCEITO DE FAMÍLIA

Resumo Português:

O conceito de família passou por modificações que permitiram a passagem de uma visão
focada exclusivamente nos aspectos formais do instituto para a sua definição instrumental,
onde cada membro deve zelar pelo desenvolvimento da personalidade do outro. Deste novo
conceito instalou-se a função social da família, cuja observância enseja a tutela estatal, fato
que motivou a ampliação das entidades familiares. O casamento perdeu a característica de
padrão configurador do instituto, o que propiciou o reconhecimento da união estável como um
arranjo equivalente, de maneira a evidenciar maior valor ao elemento afetivo da relação.
Neste contexto, a união estável foi reconhecida como entidade familiar pela Constituição
Federal de 1988, dispondo da mesma proteção constitucional garantida em virtude do
matrimônio, bem como sendo assegurado aos companheiros direitos iguais aos cônjuges,
quando decorrentes do vínculo familiar.

The concept of family has undergone modifications that allowed passage of a vision focused
exclusively on the formal aspects of the Institute for an instrumental definition according to
which each member must ensure the development of the personality of another. Therefore, it
was installed this new concept to the social function of family, compliance with which entails
the government framework, a fact which led to the expansion of family entities. Marriage has
lost its characteristic pattern of a configurative institute, which allowed us to recognize the
union as a stable equivalent arrangement, in order to show more value to the affective element
of the relationship. In this context, the stable union was recognized as a family by the
Constitution of 1988, featuring the same constitutional protections guaranteed by virtue of
marriage, as well as companions assured equal to spouses, when arising from the family
relationship.
